General Terms and Conditions (GTC) with Customer Information

(The following General Terms and Conditions also contain legal information regarding your rights under the regulations governing distance contracts and electronic commerce.)

1. Scope

1.1 These General Terms and Conditions apply exclusively to the business relationship between the Parelli Shop, owner La Randulina GmbH, Winkel 6, CH-7012 Felsberg (hereinafter referred to as the “Seller”), and the customer (hereinafter referred to as the “Customer”) in the version valid at the time of the order.

1.2 Deviating conditions of the customer will not be recognized unless the seller expressly agrees to their validity in writing.

1.3 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.

2. Offers and Product Descriptions

2.1 The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

2.2 Product descriptions, illustrations and other information serve for informational purposes and do not constitute a guarantee.

2.3 All offers are valid while stocks last unless otherwise stated. Errors, technical changes and price changes remain reserved.


3. Ordering Process and Conclusion of Contract

3.1 The customer may place products in the shopping cart without obligation.

3.2 By clicking “Proceed to checkout”, the customer proceeds to complete the order process.

3.3 By clicking the button “Place order with obligation to pay”, the customer submits a binding offer to conclude a purchase contract for the goods contained in the shopping cart. Before submitting the order, the customer may review and correct their data at any time.

3.4 The seller confirms receipt of the order by e-mail (order confirmation). This does not yet constitute acceptance of the contract.

3.5 The purchase contract is concluded once the seller dispatches the goods or expressly confirms the shipment or acceptance of the order by e-mail.

3.6 In the case of advance payment, the contract is concluded when the payment details are provided. If payment is not received within 10 calendar days, the seller is entitled to withdraw from the contract.


4. Prices and Shipping Costs

4.1 All prices include the statutory value-added tax applicable in the country of delivery.

4.2 Additional shipping costs will be shown separately during the order process.

4.3 For deliveries to countries outside Switzerland or the European Union, additional customs duties, taxes or fees may apply and must be borne by the customer.

4.4 Deliveries to countries of the European Union are shipped from the warehouse in Hörbranz (Austria). For these shipments no Swiss customs duties or import charges apply.


5. Delivery and Availability

5.1 If a product is not available at the time of the order, the seller will inform the customer without delay.

5.2 If a product is permanently unavailable, no contract will be concluded. Payments already made will be refunded immediately.

5.3 If delivery is delayed by more than two weeks, the customer has the right to withdraw from the contract.

5.4 Delivery delays due to force majeure or official measures (e.g. customs clearance) do not entitle the customer to claims for damages.


6. Payment Terms and Default

6.1 The customer may choose from the payment methods offered during the order process.

6.2 In the case of payment by invoice, the invoice amount is due within 10 days from the invoice date.

6.3 In the event of late payment, the customer owes default interest of 5% per year.

6.4 A reminder fee of CHF 15 may be charged for the second reminder.

6.5 The right to claim further damages caused by default remains reserved.

6.6 Set-off is only permitted with undisputed or legally established claims.


7. Retention of Title

The goods remain the property of the seller until full payment has been received.


8. Warranty and Guarantee

8.1 The statutory warranty provisions apply.

8.2 A guarantee exists only if it has been expressly granted in writing.

8.3 For customers residing in the European Union, the statutory warranty period is two years from delivery of the goods.


9. Liability

9.1 The seller shall be liable without limitation in cases of intent or gross negligence as well as for injury to life, body or health.

9.2 In the case of slight negligence in the breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract.

9.3 Any further liability is excluded. Liability under product liability law remains unaffected.


10. Right of Withdrawal (Switzerland)

Customers residing in Switzerland are granted a voluntary right of withdrawal of 14 days from receipt of the goods. Return shipping costs shall be borne by the customer unless the delivery was incorrect or defective.


11. Right of Withdrawal (European Union)

Customers residing in the European Union have the right to withdraw from this contract within fourteen (14) days without giving any reason.

The withdrawal period is fourteen (14) days from the day the customer or a third party designated by the customer takes possession of the goods.

To meet the withdrawal deadline, it is sufficient to send the withdrawal before the deadline expires.

In the event of withdrawal, all payments including delivery costs will be refunded within fourteen (14) days. The refund will be made using the same payment method used for the original transaction.

The seller may refuse reimbursement until the goods have been returned or proof of return shipment has been provided.

The customer bears the direct costs of returning the goods.


12. Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to goods

– manufactured according to customer specifications
– clearly tailored to personal needs
– sealed goods if the seal has been removed after delivery and which are not suitable for return due to health protection or hygiene reasons.


13. Returns

Returns must be announced to the seller in advance.

Goods must be carefully packed and returned if possible in their original packaging.


14. Storage of Contract Text

The contract text is stored and sent to the customer by e-mail. The terms and conditions can be accessed online at any time.


15. Data Protection

Personal data is processed in accordance with the applicable data protection laws.

For customers residing in the European Union, the GDPR applies.
For customers residing in Switzerland, the revised Swiss Data Protection Act (revDSG) applies.


16. Savvy Club Membership

Savvy Club prices apply exclusively with an active membership.

If membership is missing or invalid, the seller is entitled to charge the price difference to the regular retail price.


17. Exchange of Halters

Exchange of halters that do not fit is possible.

In the event of defects or incorrect delivery, the seller bears the shipping costs.

If the exchange is requested by the customer, the customer bears the shipping costs.


18. Courses, Events and Services

18.1. Scope

These provisions apply to all courses, events, seminars and services booked via the online shop.


18.2. Registration and Conclusion of Contract

By booking a course or event, you submit a binding registration.
The contract is concluded upon our confirmation.
Participant numbers are limited. Registrations are considered in the order they are received.


18.3. Payment Terms

The participation fee must be paid immediately or within the specified deadline.
If payment is not made on time, we reserve the right to reassign the spot.


18.4. Cancellation by Participant

Courses and Events without Horse (e.g. spectators, seminars)

  • Cancellation up to 14 days before the event:
    → full refund
  • Cancellation up to 7 days before the event:
    → 50% refund
  • Cancellation less than 7 days before the event or no-show:
    → no refund

Courses and Events with Active Participation (e.g. riders with horse)

  • Cancellation up to 30 days before the event:
    → full refund
  • Cancellation up to 14 days before the event:
    → 50% refund
  • Cancellation less than 14 days before the event or no-show:
    → no refund

18.5. Substitute Participant

You may nominate a substitute participant at any time.
Requirement: The substitute must meet the participation requirements.
No additional fees will be charged.


18.6. Cancellation or Changes by the Organizer

We reserve the right to:

  • cancel events for valid reasons (e.g. illness, insufficient number of participants, force majeure)
  • adjust the program, schedule or instructors

In such cases:

  • Participation fees already paid will be fully refunded
  • Any further claims (e.g. travel or accommodation costs) are excluded

18.7. Liability

Participation is at your own risk.
We accept no liability for accidents, damages or losses to the extent permitted by law.
For events involving horses, each participant is responsible for their own horse.


18.8. Participation Requirements (for Horse Events)

  • Horses must be healthy, insured and adequately prepared
  • Participants must provide all legally required documents (e.g. vaccinations, Coggins test)

18.9. Non-Attendance

In case of early withdrawal or no-show, no refund will be granted.


18.10. Photo and Video Recordings

Photo and video recordings may be made during the event.
These may be used for marketing and documentation purposes.


Ticket Policy

  • No physical tickets will be issued
  • Access is managed via participant list and/or wristband

19. Jurisdiction, Applicable Law and Contract Language

19.1 For consumers, the statutory place of jurisdiction applies.

19.2 For merchants, the place of jurisdiction is the seller's registered office.

19.3 Swiss law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection regulations provide otherwise.
